环境剥夺与环境补偿探讨

目前,国内外环境保护研究与实践,普遍存在环境至上论倾向,忽略了环境保护区居民的传统权利,出现假借环境保护剥夺环境对当地居民生产生活的传统支持作用,致使他们的发展受到限制。对此,应该引进环境补偿制度,投资生态环境重建的同时,承认环境保护区居民具有的主体优先发展权利,对环境保护区居民因环境保护而开发环境资源的传统权利受到约束给予补偿,实现可持续发展战略中的公平原则与发展原则的统一。

STUDY ON ENVIRONMENTAL DEPRIVATION AND ENVIRONMENTAL COMPENSATION

There is a shortcoming in research on environment protection, most papers and reports pay more attention on environment, and forget the environmental support function to dwellers, which causes a new environmental problem, the environmental deprivation to some people, which limits the development of the undeveloped regions. So this paper indicates we should build a new system of environmental compensation, while restoring natural environment, we should admit the priority right of dwellers to environment, and compensate the damage of dwellers caused by deprivation of tradition exploitation right. Just as that, the fairness principle and development principle could be factually combined.
