完善我国矿业立法应突出解决的几个问题

从中外矿业立法史的回顾入手,借鉴中外矿业立法经验,指出我国现行矿业立法的不足之处,进而提出了继承我国矿业立法成果的、与国际接轨的、适合我国国情的矿业权运作与管理的立法框架。就矿业权性质、与土地使用权的协调、矿业管理规范的完善进行了论述。

Some issues in consummating legislation of mining industry in China

Based on the review of the legislative evolution in the field of mining industry and the use of legislative experience for reference both home and abroad,the author pointed out the inadequacy of China's current legislation in the field of mining industry,focused on the legislative structure that should inherit our legislative fruits,accommodate to international practice and adapt to China's practical situation on the operation and administration of mining rights.Finally,the author stressed the properties of mining rights,the coordination of the use of land and the standardization mining administration.
