| 摘 要： | 死刑威慑功能的实现需要一定条件。在对死刑威慑功能的实现条件进行分析的基础上指出死刑威慑功能是否存在和死刑威慑功能是否实现是两个不同问题 ,实现条件不存在所导致的死刑威慑功能没有顺利实现不能否认死刑威慑功能的客观存在 ,并提出最大限度实现死刑威慑功能的合理化建议。

| Abstract: | The realization of the deterring function of death penalty needs some conditions. Based on the analysis of the realizable conditions of the deterring function of death penalty, the article points out that whether the deterring function exists and whether the deterring function is realized are different questions. The unrealization of deterring function of death penalty because of inexistence of realizable conditions can't negate the existence of the deterring function of death penalty, then, advances rational suggestions on how to realize the deterring function of death penalty extremely. |
