湿地认证法律原则和制度探析

为了保护湿地，对湿地进行认证，运用文献研究和比较研究的方法，研究湿地认证工作中必须适用的法律原则和法律制度，为湿地认证工作提供法律依据。研究表明：湿地认证作为中国湿地及其生物多样性保护的重要方法之一，尚无统一的湿地认证的法律规范标准，在法律理论研究及湿地保护实践中都是空白。湿地认证应当遵循的原则是优先体现生态效益原则、弹性认定原则、综合性认定原则、申请与强制认证相结合原则和可持续发展认证原则；在湿地认证工作中要适用公众参与认证制度、湿地认定补偿制度、湿地认证等级制度和认证许可证制度。

The Analysis of Law Principle and System on Wetland Authentication

In order to protect the wetland,carry on the authentication to the wetland,The method of literature search and the comparison was research was used to study the principle of legality and the legal regime which were feasible in the wetland authentication work,and the legal basis for it was provided.The results indicated that wetland authentication was one of important methods for protecting wetland and biological diversity in China,but up to now it could not be found in the research of legal theory and the practice of wetland protection,and unified standard of legal nom of wetland authentication.Wetland authentication should be keep to the principles of priority reflecting ecological benefit,elastic determination,synthetic cognizance,application and compulsory certification combination and sustainable development assertion;the systems of public participation authentication,wetland authentication compensation,wetland authentication hierarchy and authentication license were used to wetland authentication works.
