Fisheries compliance has been identified as key to sustainable fisheries management. However, it has been widely acknowledged that the approach by many governments worldwide to achieve compliance is largely through law enforcement efforts. Although theories of normative action have expanded compliance thinking from that of rationalist approaches, this paper takes the argument further. By drawing on criminology and security discourse, and on empirical research on small-scale fisheries in South Africa, this paper argues for a new approach to our understanding of compliance. Furthermore, it argues that rather than taking law as given, the formation of law and the power dynamics influencing such processes are critical aspects that need to be acknowledged and understood in fisheries compliance theory.  相似文献

Over 3000 predominantly small-scale fishers have exited the New Zealand's quota management system (QMS) between its inception in 1986 and 2000. This study, based on the Ministry of Fisheries database and a questionnaire sent to the exiters, establishes that compliance costs in general, and those specifically related to the QMS, were one of the most consistent reasons for exit. Uncertainty about future QMS policy and the high cost of quota were also significant factors. It appears that the small fishers’ perception of high compliance cost can be supported by industry data.  相似文献

The results of a 2007 survey of fishers, managers, scientists, and enforcement officials indicate that noncompliance is a significant problem in the Northeast multispecies groundfish (NEGF) fishery, as it has been for at least 20 years. The percent of total harvest taken illegally is estimated to be 12–24%, which is significantly higher than estimates of 6–14% in the 1980s. Thirty-seven percent of fishers, 61% of fishery managers and 80% of fishery enforcement staff believe that “the combined adverse impact of all violations on the health and manageability of fish resources” is significant, highly significant, or extremely significant. Many fishers believe that illegal fishing will prevent them from ever benefiting from stock rebuilding programs.  相似文献

Wildlife tourism (including pinniped tourism) offers people the opportunity to see wildlife in their natural environment. It can provide positive outcomes for the animals, through improved resources for conservation, or negative outcomes, such as inducing the animals to move away. This study assessed the impacts and sustainability of a novel but growing tourism industry, swimming with seals, based on interactions with New Zealand fur seals (Arctophoca australis forsteri) in the Bay of Plenty, New Zealand, between December 2011 and March 2012. The behaviour of all seals in the water (interaction, neutral, and avoidance) was monitored at 1 min intervals, during 16 seal-swim events. Seals mostly ignored the swimmers (54% of records), some interacted with swimmers (41%); seals rarely avoided the swimmers (5%). Interactions peaked in frequency at 6 min into the swims, then declined. They occurred most frequently during December, corresponding with the pupping period when juvenile seals—the age class most likely to interact—are excluded from breeding areas and so spend much of their time in the water. Compliance of tour operators to regulations was also monitored during seal-swim activities and the industry was found to be highly compliant. The results suggest the activities monitored had minimal impact on seals in the water, and are likely to be sustainable in relation to seal conservation. Tourism can be site and time specific, and it is recommended that approaches such as those trialled here be adopted to monitor other wildlife tourism activities to ensure their sustainability. Further research needs to examine potential impacts of the tours on seals ashore.  相似文献

We critically review the Kyoto Protocol and thirteen alternative policy architectures for addressing the threat of global climate change. We employ six criteria to evaluate the policy proposals: environmental outcome, dynamic efficiency, cost-effectiveness, equity, flexibility in the presence of new information, and incentives for participation and compliance. The Kyoto Protocol does not fare well on a number of criteria, but none of the alternative proposals fare well along all six dimensions. We identify several major themes among the alternative proposals: Kyoto is “too little, too fast”; developing countries (DCs) should play a more substantial role and receive incentives to participate; implementation should focus on market-based approaches, especially those with price mechanisms; and participation and compliance incentives are inadequately addressed by most proposals. Our investigation reveals tensions among several of the evaluative criteria, such as between environmental outcome and efficiency, and between cost-effectiveness and incentives for participation and compliance.  相似文献

The European fisheries management is currently undergoing a fundamental change in the handling of catches of commercial fisheries with the implementation of the 2013 Common Fisheries Policy. One of the main objectives of the policy is to end the practice of discarding in the EU by 2019. However, for such changes to be successful, it is vital to ensure stakeholders acceptance, and it is prudent to consider possible means to verify compliance with the new regulation. Remote Electronic Monitoring (REM) with Closed-Circuit Television (CCTV) has been tested in a variety of fisheries worldwide for different purposes and is currently considered as one possible tool to ensure compliance with a European ban on discards.This study focuses on Danish fishery inspectors and on fishers with REM experience, whose opinions are less well known. Their views on the landing obligation and on the use of REM were investigated using interviews and questionnaires, and contrasted to some fishers without REM experience. 80% of fishery inspectors and 58% of REM-experienced fishers expressed positive views on REM. 9 out of 10 interviewed fishers without REM experience were against REM. Participation in a REM trial has not led to antipathy towards REM. Fishery inspectors saw on-board observers, at-sea control and REM as the three best solutions to control the landing obligation but shared the general belief that the landing obligation cannot be enforced properly and will be difficult for fishers to comply with. The strengths and weaknesses of REM in this context are discussed.  相似文献

Sustainable management of wild fish stocks by means of catch quotas requires reliable data on fishing mortality. Norwegian authorities have attempted to ensure the reliability of this data through catch report procedures and a ban on dumping. The reliability of data on fishing mortality depends on the fishers’ compliance with these regulations. This article outlines the main factors that govern compliance and non-compliance in the Norwegian pelagic fisheries. Data was generated during fieldwork in the offshore pelagic fishing fleet.  相似文献

Ground water bodies are important resources for drinking water, including bottled water, and national regulatory bodies should assess their quality continuously. For this purpose, an effective assessment system of bottled water at source should be installed. A hierarchical nested balance design for the collection of random primary duplicate water samples, and their replicate analyses, is described, and the use of robust analysis of variance to estimate measurement uncertainty. The latter is subsequently used for the development of four probabilistic categories for the classification of element concentrations in bottled water with respect to legislative standard values, i.e., (a) compliant (below Lower Threshold Limit), (b) possibly non-compliant (possibly above Standard Value), (c) probably non-compliant (probably above Standard Value), and (d) non-compliant (above Upper Threshold Limit), for the reliable assessment of compliance to European Union and national drinking water standards. Overall, the quality of European bottled water is considered good, with the exception of a few that have concentrations in Mn, B, Ba, As, Fe, Ni, Se, and Al, which are definitely above the estimated respective Upper Threshold Limit and, thus, exceed the corresponding legislative standard value defined by European Union directives. National regulatory bodies should verify these results, and install an efficient assessment system of compliance to regulatory limits using the methodology described in this paper.  相似文献

We study the mechanical deformation of fractures under normal stress, via tangent and specific fracture stiffnesses, for different length scales using numerical simulations and analytical insights. First, we revisit an equivalent elastic layer model that leads to two expressions: the tangent stiffness is the sum of an “intrinsic” stiffness and the normal stress, and the specific stiffness is the tangent stiffness divided by the fracture aperture at current stress. Second, we simulate the deformation of rough fractures using a boundary element method where fracture surfaces represented by elastic asperities on an elastic half‐space follow a self‐affine distribution. A large number of statistically identical “parent” fractures are generated, from which sub‐fractures of smaller dimensions are extracted. The self‐affine distribution implies that the stress‐free fracture aperture increases with fracture length with a power law in agreement with the chosen Hurst exponent. All simulated fractures exhibit an increase in the specific stiffness with stress and an average decrease with increase in length consistent with field observations. The simulated specific and tangent stiffnesses are well described by the equivalent layer model provided the “intrinsic” stiffness slightly decreases with fracture length following a power law. By combining numerical simulations and the analytical model, the effect of scale and stress on fracture stiffness measures can be easily separated using the concept of “intrinsic” stiffness. We learn that the primary reason for the variability in specific stiffness with length comes from the fact that the typical aperture of the self‐affine fractures itself scales with the length of the fractures.  相似文献
