An inherent tension exists between legal approaches to nature conservation and fisheries management in the European Union, as the former remains the remit of Member States while the latter is under the exclusive legislative jurisdiction of the European Community (EC). This tension is of particular importance when addressing the conservation of habitats or species that are under threat from fishing activities. This article examines recent developments in offshore marine conservation in the North-East Atlantic in light of the legislative developments and political frameworks that are currently evolving. By analysing the emergency closure of the Darwin Mounds area of cold-water corals and the UK pair-trawl ban, it becomes evident that the precautionary principle is a key factor in the tension between fisheries management and marine nature conservation, and is not always taken into account. 相似文献

The roots of the Canadian harp seal hunt can be traced to the 16th Century. But in the mid-20th century, opposition to the commercial hunt became widespread after television images of seal pups being killed with clubs on the pack ice off the coast of Newfoundland were broadcast around the world. International conservation groups, animal welfare groups, animal rights groups, and foreign governments have been calling for the Canadian government to end the commercial seal hunt on the grounds that it is inhumane and that harvest levels are unsustainable. The Canadian government defends the traditional practices of hunting harp seals, argues that seal pelts are an important source of income for sealers, and insists that the killing methods are humane and that harvest levels are sustainable. Emotions run high on both sides of the debate. The purpose of this paper is to evaluate whether or not there is a purely economic argument for ending Canada's commercial seal hunt. The paper finds that the benefits of ending the commercial hunt exceed the costs, but not unequivocally. However, the paper argues there should be a higher criterion—the Pareto criterion—for ending the commercial hunt; that is the hunt should end only if winners compensate the losers. The paper goes on to argue that an effective way to satisfy this criterion is to introduce a system of individual transferable quotas (ITQs) and let the market reveal the value of the commercial seal hunt. In addition to many other advantages such as improving the safety and efficiency of the hunt, the ITQ market could provide a mechanism by which those willing to pay to end the hunt could do so directly to sealers thereby ensuring that the hunt is scaled back or ultimately ended only when it is economically efficient and unambiguously welfare-improving. 相似文献

For decades, cetacean bycatch has been a major conservation and welfare concern in Europe, with high numbers of harbour porpoises, dolphins and whales continuing to die each year. Despite binding legal requirements to reduce bycatch, there has been limited effective monitoring or mitigation. Bycatch is also an important welfare issue. At this critical juncture, with discussion of incorporating monitoring and mitigation of bycatch of protected species in Europe into the Data Collection Framework and Technical Measures Framework taking place to help deliver the reformed Common Fisheries Policy (CFP), a clear, effective strategy could identify the steps that are required by all EU Member States to reduce bycatch towards zero. Here, implementation of current monitoring and mitigation obligations are reviewed. Recommendations are made for the provision of clear EU guidance in order to improve and unify population surveillance and bycatch monitoring, with enhanced implementation and enforcement from Member States. A more regionalised evidence-based approach to monitoring and mitigation is in line with the move to more regionalised management under the CFP, with Member States robustly showing that bycatch levels are decreasing over a set period of time (e.g. 5 years) by a specified amount. To this end, an EU Action Plan on Cetacean Bycatch, comparable to the existing 2012 Action Plan for reducing incidental catches of seabirds in fishing gear, might be beneficial and could ultimately form a model for an international Food and Agricultural Organisation (FAO) Cetacean Bycatch Reduction Action Plan. 相似文献

大跨越输电塔-线体系对导线覆冰等环境荷载反应敏感,容易发生动态倒塌破坏。目前对线路覆冰下输电塔的振动问题虽然取得了一定的研究成果,但是线路覆冰下输电塔的动力特性规律尚需进一步研究。本文以实际工程为例,建立了大跨越输电塔-线体系数值分析模型,分析了导线划分精度对输电塔-线体系动力特性的影响,并在此基础上分析了导线覆冰对输电塔-线体系动力特性的影响。研究结果表明:导线划分精度对输电塔振动影响较大;导线覆冰不仅影响输电塔振动频率,而且对输电塔振型也有较大影响,尤其是对输电塔横担的振动影响更大。 相似文献

Although overexploitation of commercial fish stocks in European waters has been in the public debate now for more than 20 years, the European Union has so far failed to implement sustainable fisheries management. Millions in subsidies paid to the fishing industry have led to significant excess capacity in the fishing fleet. Various feeble attempts to stop overexploitation of marine resources have failed. The cause is that fishing policy is highly dominated by short-term socioeconomic interests. There is an urgent need for a new fisheries management system in Europe that supports reductions in the fishing fleet, increases responsibility among fishers and guarantees long-term conservation of natural marine resources.Transferable rights to fish have proved a reliable and effective means of creating incentives to conserve marine resources. By strengthening individual fishing rights under flexible quota management systems, the EU Member States could, within the Common Fisheries Policy, make a significant contribution to conserving fish stocks, to reducing excess capacity and to raising the profitability of the fisheries industry. The Padu system of South Asia has received growing attention as an example of customary marine tenure that has survived despite rapid development and change throughout the region’s fisheries. This paper describes the Padu system as it functions at Pulicat lagoon, India, where it has enjoyed decades of legitimacy amongst its members, and has contributed to sustainable fishing. Recently, however, the Padu system has become unstable, driven by pressures of an expanding fishing population, reduced access to fishing grounds and a growing ‘shared poverty’. In spite of this, fisher loyalty to uphold the Padu system remains strong. This raises questions about the broader social, political and cultural meanings of Padu, which extend beyond access to a lucrative fishery. The paper highlights a trade-off between the benefits received through Padu membership at a societal level through collective action, and the individual costs of partaking in ‘shared poverty’, which is inherently distributed unequally amongst fishing families. The paper concludes with a discussion on the future of the Padu system in Pulicat, drawing from evolutionary pathways of other Padu systems in the region. It is suggested that, in the Pulicat case, the high social values attributed to the Padu system, alongside complex power structures, may hinder institutional adaptation. 相似文献
