Since the advent of Western European exploration questions have been raised about the legality and morality of claims to new territories and the ensuing, often brutal colonisation patterns. The doctrine of discovery justified the acquisition of territories by conquest or other means. By the 19th century British common law included the doctrine of continuity, which recognised that the property rights of the indigenous people survived after the Crown acquired sovereignty over their territories. The Crown used a general treaty of cession and protection as the instrument for gaining sovereignty. In the context of Western European colonisation, this article discusses the statutory and judicial recognition of New Zealand’s Treaty of Waitangi 1840 and native title to land. The ensuing discussion highlights statute and judicial decisions that depart from the Treaty and are unique within the British colonies. This article also discusses the settlement of Treaty-based claims to land and fisheries and the current debate regarding ownership of the land along the seacoast and beneath the sea. The article contributes to the broader discussion on indigenous rights. 相似文献

A generalized precompiler for systems performing algebraic manipulation of Poisson series has been written. It accepts a trigonometric superset of FORTRAN IV similar to Jefferys' TRIGRUN language (Jefferys, 1972) and generates a valid FORTRAN IV program which drives an abstract formula manipulation machine. This machine is designed to be generally compatible with any manipulation system, and has been implemented with two such systems. Interpretations of current and past results from ground-based solar diameter measurements, as well as the planning of scientific programs for the 1980's, are strongly dependent on the perceived level of the degrading effects of the Earth's atmosphere. One of the more effective approaches has been to design the observing program and the subsequent data analysis such that the solar diameter measurements themselves could provide an evaluation of atmospheric effects. Many important results have been obtained in studies of this type and these results are collected here to help in appraising the current situation. This evidence all points in one direction: the Earth's atmosphere, while complicating the design of observational programs, is not the source of the oscillations observed in solar diameter measurements. Further, this same evidence indicates that the Earth's atmosphere will not pose any serious limitations in ground-based solar diameter studies during the 1980's. 相似文献

Hydrated mineral surfaces play an important role in many processes in biological, geological, and industrial applications. An energy force field was developed for molecular mechanics and molecular dynamics simulations of hydrated carbonate minerals and was applied to investigate the behavior of water on the calcite surface. The force field is a significant development for large-scale molecular simulations of these systems, and provides good agreement with experimental and previous modeling results. Simulations indicate that water molecules are significantly ordered near the calcite surface. The predominant surface configuration (75-80%) results from coordination of a water molecule with a single calcium cation-carbonate anion pair, while the less common situation involves water coordination with two ion pairs. Surface restructuring and variation in coordination in the water layers results in distinct distances for water oxygens above the calcite surface—a two-component first monolayer (2.3 and 3.0 Å) and a secondary monolayer (5.0 Å). The different coordinations also alter lateral displacement, hydrogen bonding, and surface-normal orientation of the water molecules. The ordering of water molecules and the formation of a unique hydrogen bonding network at the calcite surface influence the physical properties of the interfacial water. Surface exchange of water molecules is observed by molecular dynamics simulation to occur at a rate of one exchange per 10 ps. Diffusion coefficients derived from mean square displacement analysis of atomic trajectories indicate a dependence of water transport based on the distance of the water molecules from the calcite surface. 相似文献

Access to government funding is one of the most effective ways to enhance the resilience for small- and medium-sized enterprises (SME) community after a disaster. Along these lines, a major focus of SME resiliency research has been on examining factors needed to keep an SME open after a disaster. This makes sense as SMEs are critical to community recovery. It seems logical that the severity of a disaster would indicate the impact to a community. Using a systems thinking methodology, we developed a hypothesis that this correlation of severity to impact breaks down over time, causing the community to quickly spiral into trouble. This paper presents an agent-based model to test our hypothesis. The results indicate the impact to a community becomes much more extreme after a threshold or “tipping point” is crossed. 相似文献

Realistic environmental models used for decision making typically require a highly parameterized approach. Calibration of such models is computationally intensive because widely used parameter estimation approaches require individual forward runs for each parameter adjusted. These runs construct a parameter-to-observation sensitivity, or Jacobian, matrix used to develop candidate parameter upgrades. Parameter estimation algorithms are also commonly adversely affected by numerical noise in the calculated sensitivities within the Jacobian matrix, which can result in unnecessary parameter estimation iterations and less model-to-measurement fit. Ideally, approaches to reduce the computational burden of parameter estimation will also increase the signal-to-noise ratio related to observations influential to the parameter estimation even as the number of forward runs decrease. In this work a simultaneous increments, an iterative ensemble smoother (IES), and a randomized Jacobian approach were compared to a traditional approach that uses a full Jacobian matrix. All approaches were applied to the same model developed for decision making in the Mississippi Alluvial Plain, USA. Both the IES and randomized Jacobian approach achieved a desirable fit and similar parameter fields in many fewer forward runs than the traditional approach; in both cases the fit was obtained in fewer runs than the number of adjustable parameters. The simultaneous increments approach did not perform as well as the other methods due to inability to overcome suboptimal dropping of parameter sensitivities. This work indicates that use of highly efficient algorithms can greatly speed parameter estimation, which in turn increases calibration vetting and utility of realistic models used for decision making. 相似文献

We present textural and thickness data on loess from 125 upland sites in west-central Wisconsin, which confirm that most of this loess was derived from the sandy outwash surfaces of the Chippewa River and its tributaries, which drained the Chippewa Lobe of the Laurentide front during the Wisconsin glaciation (MIS 2). On bedrock uplands southeast of the widest outwash surfaces in the Chippewa River valley, this loess attains thicknesses > 5 m. OSL ages on this loess constrain the advance of the Laurentide ice from the Lake Superior basin and into west-central Wisconsin, at which time its meltwater started flowing down the Chippewa drainage. The oldest MAR OSL age, 23.8 ka, from basal loess on bedrock, agrees with the established, but otherwise weakly constrained, regional glacial chronology. Basal ages from four other sites range from 13.2 to 18.5 ka, pointing to the likelihood that these sites remained geomorphically unstable and did not accumulate loess until considerably later in the loess depositional interval. Other OSL ages from this loess, taken higher in the stratigraphic column but below the depth of pedoturbation, range to nearly 13 ka, suggesting that the Chippewa River valley may have remained a loess source for several millennia. 相似文献

Twenty-four soil pedons on each of four sandy lake terraces in northwestern lower Michigan that ranged in age from 3000 to 11,000 years BP were studied to assess trends in soil morphological variability with time. After verifying the general uniformity of parent materials within and between the four surfaces, we examined temporal trends in the spatial variability of soil color, cementation, horizon thickness and development. E horizons attained high color values (lightness) by 3000 years and changed little after that time, whereas B horizons continued to get darker with time. Cementation within B horizons increased in strength and amount with time, as did B horizon thickness. Soils ≥4000 years old had deeper eluvial zones but much greater variabilities in the thickness of that zone than did younger soils. Soil development increased with time, but spatial variability in degree of development also increased with time. These patterns are best explained by invoking spatially random soil mixing upon a surface that is otherwise undergoing podzolization. The objectives of this study were to determine (1) if and where lithologic discontinuities are present in the late Pleistocene Northport drumlins of NW lower Michigan, and (2) the sedimentary processes responsible for the discontinuities. Determining the presence of lithologic discontinuities was achieved through field observations and laboratory analysis. Lithologic discontinuities with varying strengths of expression were found in all upland soils. Upland soils typically have a sedimentologic “cap” dominated by fine sands at the surface with dense, more gravelly till beneath. The occurrence of this cap on upland sites, as well as overlying laminated silts and clays in some inter-drumlin areas, suggests that upland soils in the Northport drumlin field formed from subaqueously reworked glacial till. To accomplish this, the Northport drumlin field must have been inundated by a previously unidentified proglacial lake, after recession of the ice margin during the terminal Pleistocene. The lake may have formed as ice blocks lay in the deep basins to either side of the drumlin field and high morainic uplands spanned the southern edge of the field, which at that time would have been severely isostatically depressed.
