The world׳s oceans are currently undergoing an unprecedented period of industrialisation, made possible by advances in technology and driven by our growing need for food, energy and resources. This is placing the oceans are under intense pressure, and the ability of existing marine governance frameworks to sustainably manage the marine environment is increasingly being called into question. Emerging industries are challenging all aspects of these frameworks, raising questions regarding ownership and rights of the sea and its resources, management of environmental impacts, and management of ocean space. This paper uses the emerging marine renewable energy (MRE) industry, particularly in the United Kingdom (UK), as a case study to introduce and explore some of the key challenges. The paper concludes that the challenges are likely to be extensive and argues for development of a comprehensive legal research agenda to advance both MRE technologies and marine governance frameworks.  相似文献

This paper reviews the principal marine and coastal policy changes in England since 1999. The key changes identified are the establishment of a strategic national marine and coastal policy direction, new marine legislation and institutions, the emergence of a marine planning framework, the consolidation of Integrated Coastal Zone Management approaches to coastal governance, the establishment of a Marine Protected Area network, and the decline of coastal partnerships. The European Union, UK National Government, and devolved administrations are identified as key influences on the governance evolution and their relative contributions are discussed. It is concluded that the English marine and coastal governance context has evolved significantly since 1999 and that the new framework, if implemented successfully, represents a genuine step towards an integrated governance framework for England's coasts and seas.  相似文献

The declining health of marine ecosystems around the world is evidence that current piecemeal governance is inadequate to successfully support healthy coastal and ocean ecosystems and sustain human uses of the ocean. One proposed solution to this problem is ecosystem-based marine spatial planning (MSP), which is a process that informs the spatial distribution of activities in the ocean so that existing and emerging uses can be maintained, use conflicts reduced, and ecosystem health and services protected and sustained for future generations. Because a key goal of ecosystem-based MSP is to maintain the delivery of ecosystem services that humans want and need, it must be based on ecological principles that articulate the scientifically recognized attributes of healthy, functioning ecosystems. These principles should be incorporated into a decision-making framework with clearly defined targets for these ecological attributes. This paper identifies ecological principles for MSP based on a synthesis of previously suggested and/or operationalized principles, along with recommendations generated by a group of twenty ecologists and marine scientists with diverse backgrounds and perspectives on MSP. The proposed four main ecological principles to guide MSP—maintaining or restoring: native species diversity, habitat diversity and heterogeneity, key species, and connectivity—and two additional guidelines, the need to account for context and uncertainty, must be explicitly taken into account in the planning process. When applied in concert with social, economic, and governance principles, these ecological principles can inform the designation and siting of ocean uses and the management of activities in the ocean to maintain or restore healthy ecosystems, allow delivery of marine ecosystem services, and ensure sustainable economic and social benefits.  相似文献

Since 2009, there has been a shift in UK marine governance with the Marine and Coastal Access Act in which a core mechanism is marine planning, designed to replace a fragmented, ad hoc, and bureaucratic process of marine management with a strategic, integrated, and centralised system. This shift has been justified by the UK government as a more efficient procedure for delivering sustainable development (SD), which is the overarching objective of UK environmental policy. This article, which is based on data from key informant interviews and secondary sources, analyses the shift to understand its aspirations and the challenges facing it. The issues focused on include its holistic approach; its centralising tendencies; its streamlining processes; and its implicit commitment to renewable energy. In these four issues there are tensions between aspirations and challenges, and the conclusion is that the success of the new mode of marine governance depends on satisfactorily resolving these tensions.  相似文献

According to the United Nations (UN) Millennium Ecosystem Assessment, there has been a dramatic decline in global biodiversity. The UN has made a global appeal for all countries to mitigate their impact on the environment. Marine environmental protection is one of the most critical and urgent issues in the world and many countries have commenced establishing marine protected areas (MPAs) by implementing ecosystem-based management (EBM) concepts. MPA planning has been considered one of the simplest and most effective methods to protect marine environments. Taiwan has recently developed policies that have focused on its marine environment, and there are plans to increase the size of Taiwan׳s MPAs to 20% of its total ocean territory by 2020, thereby achieving a sustainable ocean. To achieve this goal, the government must address specific difficulties associated with the location of MPAs and relevant zoning strategies. This study establishes MPA protection principles and a zoning framework for MPAs in Taiwan by using Gueishan Island in Yilan County as a case study site to examine specific zoning strategies. The protection of 3 objectives (hydrothermal vents, cetacean, and fisheries resources) is discussed in this paper. Multi-criteria spatial analysis and a geographic information system are applied to identify the most crucial area to protect. To understand the stakeholders׳ opinions and concerns regarding the proposed zoning framework, this research conducted in-depth interviews with experts and stakeholders. MPAs zoning strategies are formulated at the conclusion of this study that could assist in protecting critical marine resources and avoiding conflicts among various usages of the marine area.  相似文献

The need for a statutory framework to manage valuable marine resources in the United States is highlighted by problems such as fragmented ocean governance and increasing conflict over the use of ocean spaces. On July 19, 2010 President Obama signed Executive Order 13547 to create a National Ocean Policy (NOP) for the United States. A subsequent Implementation Plan, released in 2013, set up hundreds of actions to be accomplished between 2013 and 2025 to address economic, community, scientific and other issues. Progress implementing the NOP appears to have stalled. The purpose of this paper is to give an overview of the NOP and its Implementation Plan, and then discuss what needs to be done to bring the vision it set forth to fruition.  相似文献

The ocean regulates the global climate, provides humans with natural resources such as food, materials, important substances, and energy, and is essential for international trade and recreational and cultural activities. Together with human development and economic growth, free access to, and availability of, ocean resources and services have exerted strong pressure on marine systems, ranging from overfishing, increasing resource extraction, and alteration of coastal zones to various types of thoughtless pollution. International cooperation and effective governance are required to protect the marine environment and promote the sustainable use of marine resources in such a way that due account can be taken of the environmental values of current generations and the needs of future generations. The high seas deserve particular attention since they suffer from a number of regulatory shortcomings due to the basic structures set out under international law. Against this backdrop, developing and agreeing on a focussed Sustainable Development Goal (SDG) specifically for the Ocean and Coasts could prove to be an essential element to provide guidance and a framework for regional implementation agreements.  相似文献

The ambitious Marine Strategy Framework Directive (MSFD) has been the focus of much marine research across Europe in the pursuit of achieving Good Environmental Status in the four European Union marine regions; Baltic Sea, Black Sea, Mediterranean Sea and North-east Atlantic. This research addresses the Strengths, Weakness, Opportunities and Threats (SWOT) of the current European marine governance structures and its relationship to implement the MSFD. Results of the SWOT analysis were acquired through a combination of approaches with MSFD experts and stakeholders including: 30 face-to-face interviews, an online survey with 264 stakeholder respondents and focus groups within each European marine region. The SWOT analysis concurrently identifies common strengths and weakness and key governance issues for implementing the MSFD for European marine regions. This paper forms one assessment within the governance component of the Options for Delivering Ecosystem Based Marine Management (ODEMM) project and presents timely issues that can be of benefit to national and European Union policy makers.  相似文献

The impacts of plastic debris on the marine environment have gained the attention of the global community. Although the plastic debris problem presents in the oceans, the failure to control land-based plastic waste is the primary cause of these marine environmental impacts. Plastics in the ocean are mainly a land policy issue, yet the regulation of marine plastic debris from land-based sources is a substantial gap within the international policy framework. Regulating different plastics at the final product level is difficult to implement. Instead, the Montreal Protocol may serve as a model to protect the global ocean common, by reducing the production of virgin material within the plastics industry and by regulating both the polymers and chemical additives as controlled substances at a global level. Similar to the Montreal Protocol, national production and consumption of this virgin content can be calculated, providing an opportunity for the introduction of phased targets to reduce and eliminate the agreed substances to be controlled. The international trade of feedstock materials that do not meet the agreed minimum standards can be restricted. The aim of such an agreement would be to encourage private investment in the collection, sorting and recycling of post-consumer material for reuse as feedstock, thereby contributing to the circular economy. The proposed model is not without its challenges, particularly when calculating costs and benefits, but is worthy of further consideration by the international community in the face of the global threats posed to the ocean by plastics.  相似文献

Policies are arising around the world, most recently in the United States, that mandate the implementation of marine spatial planning as a practical pathway towards ecosystem-based management. In the new United States ocean policy, and several other cases around the globe, ecosystem services are at the core of marine spatial planning, but there is little guidance on how ecosystem services should be measured, making it hard to implement this new approach. A new framework is shown here for practical, rigorous ecosystem service measurement that highlights contributions from both natural and social systems. The novel three-step framework addresses traditional shortcomings of an ecosystem services approach by giving managers and scientists the tools to assess and track: (1) the condition of the ecosystem (supply metrics), (2) the amount of ocean resources actually used or enjoyed by people (service metrics), and (3) people's preference for that level of service (value metrics). This framework will allow real world progress on marine spatial planning to happen quickly, and with a greater chance for success.  相似文献

Growing concern over the threat of global climate change has led to an increased interest in research and development of renewable energy technologies. The ocean provides a vast source of potential energy resources, and as renewable energy technology develops, investment in ocean energy is likely to grow. Research in ocean thermal energy conversion, wave energy, tidal energy, and offshore wind energy has led to promising technologies and in some cases, commercial deployment. These sources have the potential to help alleviate the global climate change threat, but the ocean environment should be protected while these technologies are developed. Renewable energy sources from the ocean may be exploited without harming the marine environment if projects are sited and scaled appropriately and environmental guidelines are followed.  相似文献

Marine renewable energy is likely to be an important part of UK energy policy over the next decades. A start has already been made, but to generate power on a significant scale requires the use of vast areas of ocean, on which there are competing claims. Legislation, and in particular the Energy Act 2004, goes a long way towards giving developers the legal infrastructure they need, to invest with confidence. But it is far from perfect, in dealing with important competing rights. This article has a narrow (but important) focus. It assumes that there are no problems over jurisdiction or international law. It is concerned principally with the rights of UK citizens. The issue is about reconciling the generation of large-scale marine renewable energy with other legitimate uses of the sea, and in particular fishing and navigation rights.  相似文献

Competing usage of marine space has prompted several coastal nations to implement marine spatial planning (MSP). While progressive governments promote the deployment of renewable energy technologies (RETs) in order to meet renewable energy capacity and greenhouse gas emissions reductions targets, offshore RETs become another player operating within a finite and already stressed marine environment. This paper applies the sectoral MSP process employed by Scotland to the Nova Scotia context in order to draft a MSP for the province's tidal energy sector. Applicable legislation is reviewed in order to establish the regulatory authorities with powers to plan for both the marine development and ecosystem protection agendas. The scoping process identifies suitable resource areas based on the operational parameters of commercially viable tidal current turbines (TCTs), while the sustainability appraisal identifies areas of cultural, industry, ecological, and socioeconomic constraint and exclusion. Plan option areas emanating from the applied methodology demonstrated a 238.345 km2 (98.1%) increase in suitable TCT deployment area than the marine renewable energy areas identified in Nova Scotia's Marine Renewable Energy Act which did not undertake such a methodology.  相似文献

Global decline of marine resources has triggered a worldwide demand for changing the way ocean resources are managed. Ecosystem-based management approaches have emerged using marine protected areas (MPA) as the main tool. Several classifications of marine protected areas benefits have been made, but all have focused only on the benefits to humans, neglecting many important benefits accrued to nature. This paper presents a new comprehensive classification of MPA benefits that will provide scientists and managers with an inclusive framework to accurately identify and account for all possible benefits derived from MPAs. The paper also analyses the methods available for valuing these benefits. A total of 99 benefits were identified within nine main categories: fishery, non-fishery, management, education/research, cultural, process, ecosystem, population and species benefits. These categories are arranged in two main divisions (direct and indirect benefits), which, at the same time, fall within the realms of benefits to humans and to nature.  相似文献

The added value of involving stakeholders in research, especially related to marine governance, seems to be understood today by many researchers and policy makers. This is clearly reflected by the many (EU) research calls explicitly asking for stakeholder involvement. The way in which to involve stakeholders in a meaningful way is however not all that clearly defined. In the EU funded project Options for Delivering Ecosystem-Based Marine Management (ODEMM) an explicit question was the development of options for alternative governance settings, including stakeholder involvement, to implement the Marine Strategy Framework Directive in the EU. In order to arrive at these possible alternative governance set-ups the ODEMM project developed a layered methodology, including structured and unstructured interviews, a survey and roundtable discussions to develop diverse governance options for future ecosystem based models at the regional seas. This paper describes the methodologies used, compares them with best practice from literature, and finally classifies the approach as a joint knowledge production, a tango, in which scientists take the lead but need the stakeholders to come to a dance.  相似文献

An essential component of ecosystem-based approaches in coastal zone management and the emerging field of marine planning are partnerships and collaborations between a range of multi-sector organisations and individuals. Ensuring that partnerships are effective is a priority for those responsible for planning and management in coastal and marine environments. Current partnership evaluation approaches, however, tend to view effectiveness as the cumulative end result of a set of variables acting in a linear process at a specific point in time. Given that governance and participation are acknowledged as non-linear and multifaceted processes, more reflective and nuanced approaches that take account of the dynamic, multidimensional and geographically embedded nature of the collaborative process are needed. This paper proposes a new framework for partnership evaluation based on policy narratives and indicators, and demonstrates the potential of the approach using three case studies of partnerships focused upon marine nature-based tourism. The insights from this research have direct relevance to the agencies and organisations responsible for delivering integrated coastal management, including marine spatial planning.  相似文献

南海区海洋垃圾污染日益恶化对治理提出了严峻的挑战,公众既是海洋垃圾污染的直接受害者,也是海洋垃圾治理的直接受益者,更可以成为南海区海洋垃圾治理的参与者。文章阐述公众参与南海区海洋垃圾治理有助于从源头上控制南海区海洋垃圾污染状况、提升南海区海洋垃圾治理决策的科学性和针对性、降低政府治理南海区海洋垃圾的人力、物力成本的必要性,分析南海区海洋垃圾治理公众参与存在公众海洋垃圾治理参与意识薄弱、公众海洋垃圾治理参与方式不足、知情权和参与权未得到充分保障、海洋环保NGO的作用未充分发挥等问题,借鉴日本濑户内海、美国墨西哥湾、厦门五缘湾等国内外区域海洋垃圾治理公众参与的实践经验,提出培育参与意识和技能、开发新兴参与方式、建立健全政策法规、发展海洋环保NGO等完善公众参与治理的对策。  相似文献
