The Falkland Islands Government has established a transferable rights management regime for its fisheries resources. The allocation of transferable rights has to be sensitive to economic and social considerations specific to the Falkland Islands. One critical requirement is the need to balance local ownership and control with the need for direct foreign investment and the continued involvement of foreign fishing fleets in the territory's fisheries. Several mechanisms to achieve this balance are contained in recent fisheries legislation. These mechanisms will be of interest to other small island territories facing similar challenges in their commercial fisheries.  相似文献

Coastal fisheries are complex ecological and social systems, evolving in time with a shift from commercial towards recreational effort. We describe the coastal fisheries of Mallorca (W Mediterranean) and the management policies implemented to show the challenges faced at regional level to handle the different management tools used to conserve biodiversity and the social fabric in the coastal zone. Our example provides evidence of the complexity of fishing rights and how they can be adapted into practical fisheries management by combining fishing rights, open access recreational fishery, community-based management and biodiversity conservation.  相似文献

The high seas fisheries are troubled by overcapacity and lax enforcement of management rules. The idea has emerged that these problems could be dealt with by property rights solutions such as ITQs. Such management tools only emerged after the 200-mile EEZ was established. This made it possible to apply the sovereign state's legislative, enforcement and judiciary apparatus to regulate fisheries. It is argued that without the EEZ such solutions would have been unlikely to emerge, and that a further extension of the EEZ is necessary to apply rights-based regulations to high seas fisheries. The current management regime of high seas fisheries lacks the necessary enforcement apparatus, which makes it necessary to apply trade sanctions, port measures and blacklisting to support regulations of high seas fisheries. It is argued that such measures are likely to be the second best, compared to further extending coastal state jurisdiction. Finally a bioeconomic model is applied to analyze potential gains from cooperation in high seas fisheries.  相似文献

Most fisheries management studies have concentrated on understanding resource dynamics and have paid less attention to understanding the dynamics of those who use the resources. This situation limits the knowledge about the fisheries system as a whole and specifically about the viability of management schemes. It is vital to understand how the actors within the fishing sector (fishing firm owners/managers, fishers, fisheries managers, and traders) may respond to changes in fishing resources trends, market dynamics, and fisheries policies before they are implemented. These issues are explored in this paper by applying a longitudinal analysis of the Yucatan Mexico's fishing industry. The analysis is presented within the framework of the theory of change and coping strategies. The study primarily involved interviews during 2008 with the main owners of companies in the fishing industry and with fisheries managers and other stakeholders. Time-series catch data on the main fishing resources are also reviewed to evaluate changes across three historical periods and describe how the actors have perceived and responded to those changes. Given conditions of uncertainty in resource availability, changes in market demand and changes in institutional arrangements, the viability of traditional business and resource management practices are discussed. The analysis presents different kind of triggers that have modified the conditions of the fishing sector and had had impacts on the socio-economic–ecological system in which fisheries are embedded. The need for adaptive strategies in the whole chain of the fisheries business and resource management is stressed, given the current changes and conditions of fisheries. The discussion states a series of actions that could improve the relationships between business practices and fisheries management.  相似文献

Although overexploitation of commercial fish stocks in European waters has been in the public debate now for more than 20 years, the European Union has so far failed to implement sustainable fisheries management. Millions in subsidies paid to the fishing industry have led to significant excess capacity in the fishing fleet. Various feeble attempts to stop overexploitation of marine resources have failed. The cause is that fishing policy is highly dominated by short-term socioeconomic interests. There is an urgent need for a new fisheries management system in Europe that supports reductions in the fishing fleet, increases responsibility among fishers and guarantees long-term conservation of natural marine resources.Transferable rights to fish have proved a reliable and effective means of creating incentives to conserve marine resources. By strengthening individual fishing rights under flexible quota management systems, the EU Member States could, within the Common Fisheries Policy, make a significant contribution to conserving fish stocks, to reducing excess capacity and to raising the profitability of the fisheries industry. A closer look at existing reservations against a flexible management system shows most of the objections to be overstated or capable of resolution.  相似文献

As catch and effort statistics including fishing time and location are essential for producing abundance indices for utilized fish stocks, fishing states are encouraged under the FAO Code of Conduct for Responsible Fisheries to collect and maintain such statistics. However, for coastal fisheries (including artisanal fisheries) that are mainly composed of small-sized vessels which are usually too numerous to monitor, fisheries statistics collection systems are often either lacking or of insufficient quality (e.g. incomplete or inaccurate). Vessel monitoring system (VMS) data are commonly used to construct or improve estimation of fishing effort and fishing location in large-scale fisheries. Most coastal fisheries lack VMS but their countries do have coastal surveillance radar systems (CSRS) for security and enforcement purposes. This study illustrates and recommends opportunistic use of CSRS data to provide similar scientific benefits to VMS data for coastal fisheries. CSRS in combination with market landings data can construct logbook-like catch and effort statistics. This study introduces a method and demonstrates its usefulness for scientific research and management purposes, including the potential to obtain a higher accuracy and precision, particularly for fishing location and catch amount. Limitations of the CSRS data and challenges to managers involved in its application are also discussed.  相似文献

Fisheries management systems based on Transferable Fishing Concessions (TFC) and similar rights-based systems have been developed during the last decades in some European countries. However, at present there is not a clear view on the possible effects caused by the application of this management systems in the Mediterranean Sea. The current study, involving nine Geographical Sub-Areas (GSAs) of the Mediterranean Sea, focuses on the appropriateness, transferability and modes of applicability of a TFC system in the Mediterranean area. Three different scenarios of quota allocation have been analyzed by taking into account biological, ecological, environmental, economic and social aspects: quota in terms of resource quantity, quota as a portion of the total fishing time, quota as a portion of the total fishing capacity. Results show that the transferability of a TFC-based system to the Mediterranean context appears to be low due to the characteristics of the Mediterranean fisheries (multispecificity of resources, fishing grounds shared among different countries, multigear, importance of small-scale fisheries) and to the general lack of sound and reliable individual historical data. The study also highlights rights-based systems such as Territorial Use Rights in Fisheries (TURF) might only be applied for the exploitation of sedentary resources, such as clams. A management system based on TFC could be theoretically reasonable for anchovy fishing, where a few species are caught, even if all countries and stakeholders should be involved in the decision making process.  相似文献

In the Alaska halibut individual fishing quota (IFQ) fishery, small remote fishing communities (SRFCs) have disproportionately lost fishing rights. Our analysis of quota market participation from 1995 to 1999 confirms that SRFC residents are more likely to sell than buy quota. Alaska Native heritage is another important predictor of quota market behavior. Residents of Alaska Native villages have an increased likelihood of selling quota. Loss of fisheries participation in small indigenous communities can be an unintended consequence of quota systems. Mitigation measures should take into account the social factors that can lead to such a redistribution of fishing rights in privatized access fisheries.  相似文献

This paper assesses the views of various environmental groups on access control in fisheries, as stated in documents prepared by these groups. The views range from outright opposition to tentative promotion. Differing views on the definition of conservation, the appropriate make-up of the fishing industry and the likely make-up with and without access control, and the appropriate nature of property rights for fisheries are highlighted. An important aspect of the last issue is the concern over potential ‘takings’ problems under the Fifth Amendment to the US Constitution when management is imposed in rights-based fisheries regimes.  相似文献

South Africa's small pelagics fishery is moving towards a management strategy using an ecosystem approach to fisheries (EAF), with rights-based management (RBM) as the key rights allocation system. While EAF strives to balance between, among others, ecological and social-economic objectives, RBM is driving the sector towards economic efficiency. Within EAF itself, there are still underlying mismatches between the two top objectives, ‘human wellbeing’ and ‘ecological wellbeing’, in effect requiring a better balance between these objectives than there is currently. For example, fishers do not believe they should be competing with marine mammals and birds for allocation of the resource, yet this is one of the primary trade-offs that have to be made when setting the annual total allowable catches (TACs) under EAF. A balance between the two objectives could be achieved through acceptable trade-offs between them among all stakeholders within inclusive governance. Implementation of RBM has had both positive and negative effects on the objectives for EAF. Of concern are the negative effects of RBM on human wellbeing. For example, fishers feel that RBM has weakened their bargaining position, thereby reducing their benefits. In addition, RBM has resulted in job losses and insecurity of employment within the fisheries sector. The most affected have been the most vulnerable — the low level workers — who ought to be the key beneficiaries of RBM. Thus prioritising and protecting vulnerable groups and fishing communities need careful consideration when creating RBM, even in the context of EAF. Rights-based management has also had negative effects on ecological wellbeing through practices such as increased dumping and ‘high grading’ as part of industry's drive for increased efficiency under RBM. Whereas scientists believe that variability is largely due to environmental conditions, fishers strongly feel that dumping, high grading and high fishing pressure are the main factors. One of the positive aspects of RBM has been improved understanding among rights-holders and fishers of the need to consider other organisms in the TAC and to protect these through establishment of marine protected areas, island perimeter closures and limiting bycatch, thereby impacting positively on ecological wellbeing.  相似文献

Atlantic Canadian fisheries policy exhibits a tension between competing objectives of economic efficiency, and of well-being and equity within coastal communities and small-scale fisheries. The struggle between different actors over these objectives has generated distinct forms of neoliberalism in different regions and fishing fleets. In the lobster fishery, the right to fish has been concentrated since limited-entry licensing policy was introduced in the 1980s. This paper examines actors and events at two scales, including Lobster Fishing Area (LFA) 34 Advisory Committee meetings involving fishermen, representatives of Fisheries and Oceans Canada (DFO), and other stakeholders, and broader scale strategies of the Canadian Independent Fish Harvesters Federation (CIFHF). A Foucauldian perspective aids in understanding how fisheries governance is the product of struggles between the power and agency of individual fishermen, fishing organizations, processing companies, the DFO, the Minister of Fisheries and the courts. While many theorists view fisheries through the lens of the “tragedy of the commons”, alternative tragedies are developing in Atlantic Canadian fisheries. These include rising levels of debt, reduced earnings, vulnerability to financial volatility, loss of fishing rights within communities, and too much processor control.  相似文献

There is a need for effective mechanisms to be in place in order to allocate fishing possibilities. This seems crucial so that distributional concerns regarding this issue are properly addressed. This paper aims at providing insights into the allocation of fishing possibilities from Basque fisheries. We put forward this case in terms of its outcomes to the incentives deployed by the allocation system. The institutional substratum plays a key role in the outcomes of the system. In fact, the fishermen's traditional collective approach predominates even though the management system tends towards individual rights allocation and promotion of rights transferability. Galicia is one of the most important fishing regions in the European Union, and this paper analyses the Galician fishing sector from a new institutional economics approach. The paper studies several topics that characterise the relationship between institutional rules and fisheries management in Galicia. Managing small-scale fisheries in a developing country like the Philippines is very challenging because of high pressures from expanding fishing population, poverty and lack of alternative options. Thus, resource-focused fisheries management initiatives such as marine protected area (MPA) establishment will likely result in further marginalization of the poor fishers which could pose more serious problems in coastal communities. In this study, the status of small-scale fisheries in 44 coastal towns in the Philippines was assessed using FISHDA (Fishing Industries' Support in Handling Decisions Application), a simple decision support tool which requires minimal or easily-generated data. Results showed that 68% (30 out of 44) of the studied towns have unsustainable fisheries unless 58% of their fishing grounds are protected from all fishing activities. Alternatively, 53% of the active fishers in towns with unsustainable fisheries must totally stop fishing to avert fishery collapse. Alarming as it may sound, this is still an underestimate as catches incurred by the highly efficient and destructive illegal fishing activities such as blast, poison and large-scale fishing, which are reported to be still rampant in many coastal areas in the Philippines, were not accounted for in this study. This study demonstrated that MPAs alone may not be enough to avert fishery collapse even if MPA size is increased from the current 3% to 15% of the municipal waters, i.e. up to 15 km from the shore, as required by the Philippine law. Various challenges confronting the fishery and important recommendations to address them are further discussed.  相似文献

It is widely recognized that fishing states are obliged to exercise flag state responsibility over their vessels. In an attempt to become a responsible fishing actor, Taiwan has endeavored to manage its distant water fishing fleet in accordance with international fisheries management. However, the long-standing problems of illegal, unreported and unregulated (IUU) fishing, fish laundering, and fishing overcapacity, which remained unsolved during the 1990s and early 2000s, brought its management capability into doubt. Failure to address these problems undermined the credibility of all management measures and ultimately resulted in a recommendation adopted by International Commission for the Conservation of the Atlantic Tunas (ICCAT) in 2005. This recommendation significantly affected Taiwan's distant water fishing policy. This paper examines how Taiwan assimilated this outside force into its fishing policy as a new response to international fisheries management and how fishers perceived this response. It shows that Taiwan's efforts in controlling distant water fisheries marked a big change, specifically manifest in three noticeable actions - reducing excessive bigeye-targeted efforts, deterring IUU fishing, and strengthening fisheries management. The study advises that management of small tuna vessels be effectively exercised and recommends future actions on providing subsidies for fishers to partially offset costs incurred by rule compliance, streamlining their administrative work, enhancing communication with them, putting more enforcement and meaningful penalties in place. Finally, the study indicates the existence of an interaction in the international fisheries management scheme, potentially favoring Taiwan to bargain for fishing rights and a favorable status in the participation of regional fisheries management organizations (RFMOs) in the future if it continues to exercise effective control of distant water fisheries.  相似文献

Marine fisheries play an important role in the economy of Sierra Leone, supporting livelihoods and contributing significantly to food security. This paper looks in detail at how the performance of fisheries was impacted by the ten year civil war, an event which contributed to the country's reputation for being a “failed state”. The paper focuses mainly on the artisanal fisheries sector, which employs the majority of the country's coastal population, and demonstrates how the conflict caused major social dislocation to fishing communities as well as reducing the productive capacity of the fleet. The paper concludes with a discussion of the policy challenges now facing Sierra Leone, particularly the prevention of resource looting through illegal fishing of the offshore stocks and the development of strategies to enable the potential wealth of these fisheries to be captured.  相似文献

北冰洋公海尚处于冰封状态,但气候变暖、海冰加速融化使未来公海出现新渔场成为可能,其战略价值因而得到国际关注。当前,环北极国家已率先展开渔业权益争夺。为分析北冰洋公海渔业事务的国际走势,文章基于博弈论思想,构建非对称懦夫博弈模型及古诺模型来模拟和探究环北极国家在渔业利益争夺中的合作或冲突行为,研究得出:现阶段北冰洋公海渔业权益争端主要表现为渔业管理权的争夺,在该博弈中,非北冰洋沿岸国采取退让策略,沿岸国采取进攻策略,可以达到进化稳定均衡;一旦公海具备捕鱼条件,争端将演化为开发模式选择的博弈,此时,北冰洋沿岸国采取合作开发策略可以有效保护公海渔业资源,并实现国家的长期利益。  相似文献

This study aims to investigate and model driving forces that lead to increased fishing pressure and an altered state of the environment in the coastal areas near Samsun on the Turkish Black Sea coast. We have applied a modified DPSIR model to structure our investigation and analysis and have investigated the drivers that generate fishing pressure in the Samsun fisheries. The overall health of the ecosystem is declining, and there is a consistent trend of deterioration in the condition of the three major species targeted by the trawl fisheries. Although introduced invasive species have brought significant changes to the Black Sea, it is clear that the state of the environment is significantly and negatively affected by the pressure exerted by fisheries. Fishing pressure has to a certain extent been redirected to pelagic trawling as bottom trawling has become less profitable and a rise in catch capacity has levelled off. This reduction is, however, offset by an increase in illegal trawling and dredging by a very rapidly growing sector of multi-purpose small boats, resulting in a considerable increase in the overall accumulated engine power of fishing boats in Samsun during 2000–2005. Fisheries in Samsun, in particular sea snail fisheries, have constituted a frontier of sorts open to the poorer populations of Samsun during the last 20 years, and, thereby, constitute one of the major drivers for fishing pressure. We identify eight drivers of importance for the period 2000–2005. Although the authorities can impact all or most of those drivers, most of them are beyond the scope of conventional ‘fisheries management’.  相似文献

Managing marine fisheries using output controls in the form of individual transferable quotas (ITQs) can be an attractive alternative to more traditional input controls. There are now a number of examples of where ITQ-managed fisheries have been able to reduce the impact of the major management problems in global fisheries, namely, gross over-capitalisation and effort. However, ITQs are not the perfect management tool and one of the lesser known consequences of ITQ-managed fisheries where ITQs consist of a harvest right is the implicit relationship between ITQ property rights and rights of access to the fishing grounds. This implicit spatial right to the grounds can provide obstacles in the way of allocating water-space within fishing grounds for alternative uses such as marine-protected areas, large-scale aquaculture, and wind farms. These lesser-known consequences of ITQ-managed fisheries are discussed here.  相似文献

Pursuant to statement issued by the Government of Vietnam on 12 May 1977, on the territorial sea, the contiguous zone, the exclusive economic zone (EEZ) and the continental shelf of Vietnam, and according to the provisions of the LOS Convention, the EEZ of Vietnam extends principally up to 200 NM from the baseline, and the area of EEZ amounts to about one million square km including the Hoang Sa (Paracel) and Truong Sa (Spratly) Islands [The declaration of the Government of Vietnam on the territorial sea, contiguous zone, exclusive economic zone and continental shelf, Hanoi, 1977]. The establishment of EEZ has significantly changed circumstances for the fisheries sector in Vietnam.Recently, even though the adaptation of new techniques and technologies to the fisheries sector has been somewhat successful and resulted in the limitation of effective exploitation opportunities, sea fishing is still very important to the economy of Vietnam. In fact, fisheries development in Vietnam has the following important objectives, whether pursued in marine or fresh water: foreign exchange earnings; protein for local diets and feeds for live stock; provision of employment. However, a matter of concern is that the outdate fishing methods and uncontrolled fishing are damaging the marine environment and living resources. These problems have been recognized and courses of action have been formulated. A prerequisite condition for resolving this issue is to have a mechanism for synchronized policies which are guaranteed by appropriate macro management. The main purposes of this paper are a review of some aspects of fisheries sector development and management in Vietnam in the light of the new regime of the EEZ, represented in the LOS Convention. An important objective of the paper is the emphasis on the problem of policy-relevant research for fisheries sector management in the future.  相似文献
