This paper provides an overview of the emerging policy landscape for marine spatial planning in the European Union, which consists of four main categories of policy drivers: environmental legislation, legislation on marine renewable energy, fisheries regulations and the Integrated Maritime Policy. The weak links between these categories of policy drivers, underpinned by a lack of clarity regarding the vision for sustainability, pose major challenges for the emergence of ecosystem-based and integrated marine spatial planning in Europe. In addition, there is still uncertainty arising from on-going reform of the Common Fisheries Policy, and discussions on the need for a new marine spatial planning directive. This paper concludes with the view that better integration of environmental concerns into the Common Fisheries Policy is needed to strengthen the link between environmental legislation and fisheries regulations, and that the existing policy landscape, particularly the Marine Strategic Framework Directive, already provides a legal framework for ecosystem-based marine spatial planning. Such a framework is consistent with the recognition that ecosystem conservation underpins other pillars of sustainable development and provides the foundation for cross-sectoral marine planning and management.  相似文献

The main objectives of fisheries management are generally similar throughout the world. These are often stated in policy documents such as the Common Fisheries Policy and the Magnuson–Stevens Fishery Conservation and Management Act. However, at the local level often the key objectives of management are more detailed, characterised by both the overriding management structure and the status and type of fishery concerned. In this paper, we consider case study fisheries from the UK, France, Spain and Denmark to compare some of the various types of fisheries and fisheries management systems that exist in the European Union. In the past decade, the European Commission has developed the Marine Strategy Directive and the Maritime Policy. Both policies aim at governing the marine environment; yet the two policies have a differing signature in policy formulation and implementation. From a fisher's perspective these policies present a change in institutional setting; major policy measures no longer descend from the EU Common Fisheries Policy alone, but increasingly are derived from general environmental policy developments. In this paper, the policy arrangement approach is used to analyse the differences between the two maritime policies, and the way in which they can affect fisheries management.  相似文献

On 22 April 2009 the European Commission published its ‘Green Paper on the Reform of the Common Fisheries Policy’. The Green Paper points out a contradiction in policy, noting on one hand that public financial support to the Community's fisheries sector is substantial, but on the other hand such support is often incompatible with other Common Fisheries Policy (CFP) objectives, particularly the need to reduce overcapacities. Providing an analytical framework to better understand the effects of subsidies as well as an overview of existing funding schemes under the CFP, this article aims at answering some of the questions posed by the European Commission within its Green Paper. Answers are based on two ideas: the exploitation of marine capture resources ultimately depends on the level of available fish stocks and that a large share of subsidies fuels the race to fish by inducing investment incentives for the fisheries sector. Policies that have ignored this tend to encourage inefficient and unsustainable fishing as well as the misallocation of public funds. Although support schemes under the CFP have changed in recent years, some problematic support schemes persist. A future reform will have to continue the course taken towards sustainable and efficient approaches to supporting the fisheries industry.  相似文献

The European fisheries policy has undergone a substantial reform. The reform process was initiated by a Green Paper published by the European Commission in 2009. It was recently finalised with an agreement on a new Basic Regulation between the European Commission, the Council and the Parliament in October 2013. The reform of the Common Fisheries Policy will be an important step towards a more sustainable fisheries policy in Europe. The most important reform steps are the introduction of maximum sustainable yield as the new management target, a landing obligation for bycatch and a governance shift towards regions. Although the mentioned reform elements are in generally very promising, their concrete design does not always meet existing expectations.  相似文献

Within the European Union, scientific fisheries research and advice is passed down a chain of central European institutions before being incorporated into policy. However, advice is often poorly or only partially implemented and the system has largely failed to achieve sustainable fisheries management.This paper aims to explain why, by examining the use of fisheries science within the Common Fisheries Policy (CFP). The problem is examined with respect to both the political system and fisheries science, to show that the factors in both the supply, and the subsequent use, of scientific data inhibit effective fisheries management.  相似文献

This article examines the evolution of foreign ownership in the UK fishing fleet in the context of policy developments at European and national levels. We argue that the characterisation of all foreign ownership as “quota-hopping” is misleading because it oversimplifies the means by which foreign access to fish quotas has been obtained. The paper considers the incentives for foreign ownership and the likely economic impact on the UK. It is concluded that the net impact may be rather small, but that the issue nevertheless raises questions for the allocation of fishing rights under the European Community's Common Fisheries Policy.  相似文献

The revision of the Common Fisheries Policy of the European Union in 2003 was communicated in a ‘Roadmap’, including the opinion of the EU Commission on how to reform the fisheries policy. This paper reviews the Roadmap and confronts the opinion and initiatives proposed by the Commission with the ‘conventional’ bioeconomic theory. The purpose is to assess to what extent the lessons of the theory could be found in the Roadmap. Having in mind the complexity of the EU fisheries, the Roadmap, in particular, focuses on fleet management policy with the aim of reducing overcapacity on a community level. This applies as a supplementary means to the conventional fish stock conservation measures. In conclusion, the EU Commission is aware of the lessons learned from the bioeconomic theory.  相似文献

Industrial aquaculture has become one of the main protagonists both on the coasts and in international policy aimed at regulating matters concerning the sea. This new role is reflected in the recently adopted Common Fisheries Policy of the European Union, where the need to promote the sector and the involvement with other local actors, specifically artisanal fishers, is highlighted. However, the official promotion of this activity could be overvaluing its benefits while, at the same time, undervaluing the new barriers that it is introducing in fisheries co-management. Centered in Valencian Community (Spain) and through a qualitative methodology, this paper examines the views and positions of stakeholders directly involved in aquaculture activity (biologists, aquaculture businessmen and policy managers) on the possibilities of joint participation. It is concluded, that eroding the detected mistrust among stakeholders through "hybrid forms of participation" would be a necessary prerequisite to setting up a common framework for involvement leading to an effective co-management.  相似文献

The Common Fisheries Policy (CFP) is a priority area of the European Union's Better Regulation agenda. Understanding the spatial variation in the application of the policy and the reasons behind these differences would provide insights into policy making in different socioeconomic and cultural settings that will assist in better regulation. The CFP aqcuis (the body of European Union law accumulated thus far) was analysed by creating a database composed of pre-defined elements from each obligation. Distinct differences are apparent in the ‘burden’ imposed by regulations in the Northern and Southern waters. However, a combination of a timeline of fish landings and the accumulation of the CFP regulations shows that despite the increase in the number of regulations this has not led to the anticipated reduction in landings. Historical, biological and geopolitical differences between the two major marine regions of the EU are discussed in terms of the impact they have had on the formation of the different fisheries management models in the different regions. Finally, the elements forming these models are discussed in terms of successes and failures in the context of the 2012 CFP reform.  相似文献

Over the past two decades profound changes have taken place in the European Union's (EU) fisheries policy. Partly these changes have occurred within the EU's Common Fisheries Policy itself, but partly policy change has been effected by the application of environmental legislation and policy instruments to fisheries issues. This article argues that the process of policy change in EU fisheries policy can best be understood in terms of the interaction of policy images and policy venues that is at the core of the punctuated equilibrium theory of policy-making. As a result of the rise of a biodiversity perspective on fisheries issues, environmental policy-makers have become active in fisheries issues, which has led to profound changes in both the content of fisheries policies and the institutional organisation around this issue area.  相似文献

Public participation in the decision-making process is a key element of good governance. In its latest proposals for reforming the Common Fisheries Policy, the European Commission acknowledges that management measures lack legitimacy without input from the fishers themselves and thus underscores the need to increase it and adapt it to local or regional conditions. This study analyzes Spanish fishermen's own views about their participation in the decision-making process. The results show that most fishers are in favor of more participation by themselves and by regional governments in the decision-making process.  相似文献

The implementation of the Natura 2000 network of marine protected areas under the European Habitats Directive (92/43/EEC) has far-reaching implications for fisheries. To date, no consistent approaches have been established to develop fisheries management measures in Natura 2000 areas, and no European member state has proposed any fisheries measures to the European Commission for consideration under the Common Fisheries Policy. Four key issues are identified in the relationship between fisheries and Natura 2000, and the possible role that the future Common Fisheries Policy could have in this context is discussed. There is a need (1) for a consistent framework to integrate scientific advice, stakeholder participation and management in the management process; (2) for a common methodology to prioritize conservation objectives, in particular for transboundary protected areas; (3) for a consistent framework to assess and evaluate fisheries impacts to define management measures; and (4) to define spatial properties for fisheries. The results from the projects EMPAS (Germany), FIMPAS (the Netherlands), and INDEMARES (Spain) and the Dogger Bank case are discussed.  相似文献

The European Common Fisheries Policy (CFP) has failed to deliver on social, economic and ecological goals. This failure is in part the result of a number of social–ecological feedback mechanisms. The policy is currently undergoing reform, with unknown practical outcomes. Here, relatively successful fisheries policies outside the European Union are reviewed. Through interviews and workshops with scientists, managers and other stakeholders, complemented with literature reviews, practices that can create incentives for long-term sustainability are investigated. The focus is on how the provision of clear and trusted scientific evidence can stimulate defensible decisions, in turn creating incentives for compliance, leading to positive social–ecological outcomes. Despite differences between Europe and the investigated case studies, the prospects of an increased regionalization within the European CFP provides the best starting point for implementing best practice identified in this study.  相似文献

The reduction of discards in European fisheries has been identified as a specific objective of the reform of the EU Common Fisheries Policy. To reduce the uncertainty in catch data and the socially unacceptable waste of resources that results from the disposal of catch at sea, a policy to ban discards has been proposed. Discard bans are currently implemented in Alaska, British Columbia, New Zealand, the Faroe Islands, Norway and Iceland. Experience from these countries highlights that a policy of mandatory landings can result in a reduction in discards, but relies upon a high level of surveillance or economic incentives to encourage fishers to land more of their catch. Discard bans will also not result in long term benefits to stocks unless total removals are reduced, through the avoidance of undersized, non-commercial or over quota catch. Experience shows that additional management measures are required to incentivise such a move towards more selective fishing. Success has resulted from the use of area closures and bycatch limits, with potential applications in EU fisheries. However, selective fishing will not be a panacea for the current state of European fisheries; discard bans and accompanying measures must be embedded in a wider management system that constrains fishing mortality to reasonable levels before sustainable exploitation can occur.  相似文献

The live reef food fish (LRFF) trade has an estimated annual retail value of US$1 billion in the Asia-Pacific region and at least US$30 million in the Philippines. Palawan Province is the trade's center accounting for as much as 55% of the commodity's total export. Concern about the LRFF trade has caused the Palawan Provincial government to take action to regulate the trade. Four key policy options to address the short-term policy objective of developing a sustainable LRFF industry through the reduction of threats associated with destructive fishing and overfishing were proposed. These four policy options and associated analyses were presented to stakeholders at three separate policy consultations. The stakeholders reached a consensus that a regulated LRFF trade was the most sensible option. As a result, the Provincial Government of Palawan took action to enact “The Palawan Live Reef Fish Ordinance of 2006”, which provides for the sustainable and integrated regulation of the LRFF industry. This provincial ordinance will assist in crafting a national policy for the LRFF trade and may also be useful in revising the 1998 Philippine Fisheries Code. The key challenge is how to translate the ordinance provisions into effective on-the-ground actions.  相似文献

In the different proposals about fishing resources management systems there is a trend to consider that some incompatibilities exist between forms of management (public intervention or co-management) and the use of instruments based in creating market of fishing rights. In this paper, we will try to leave behind this incompatibility by means of a new concept of management system, which distinguishes accurately the instrument from the institutional framework under which the former is applied. We can see the usefulness of our concept in the European Union fisheries management. Although there is a common policy for all Member States, the way some countries have implemented the Community Regulations has changed the institutional framework which determines the fishermen's activity. The results of our analysis become more outstanding since The Green Paper on the Future of the Common Fisheries Policy emphasises the need to share with the fishermen the drawing-up of the fisheries policy.  相似文献

The European Union is aiming to implement an Ecosystem Approach for the management of all human activities in the marine environment, hereunder the fisheries sector. Since the last reform of the Common Fisheries Policy in 2013, several analyses have highlighted the barriers and challenges to this aim. Despite the claim that much of the framework to support the implementation of an EAFM in Europe is in place, the findings point out to deterrent features within the governance system. Beyond the overall policy framework, this paper explores the implementation of the multiannual multispecies management plans as one of the real moves towards Ecosystem Approach to Fisheries Management. This is carried out on the basis of two case studies that address the design of multiannual multispecies management plans for the Baltic Sea and for the Atlantic Pelagic fisheries. The analyses strengthen with empirical evidences our understanding of the challenges ahead including, among others, an institutional gap between fisheries and environmental policy frameworks resulting in a limited integration of broader environmental concerns in one of the proposed plan and the standoff between decision-makers that delays the adoption and use of proposed management plans and creates frustration for the involved agencies.  相似文献
