Rapid advances in attaching miniaturized electronic devices to marine animals for the purpose of learning more about their behavior and interaction with the marine environment, known as bio-logging, raise important and unsettled questions under the international law of the sea. Part XIII of the United Nations Convention on the Law of the Sea (UNCLOS) provides coastal states with the right to regulate and authorize marine scientific research in offshore areas under their sovereignty and jurisdiction. In their recent article published in this journal, James Kraska, Guillermo Ortuño, and David W. Johnston, assert that although bio-logging is a form of marine scientific research, Part XIII of UNCLOS does not apply to tagged animals that collect scientific information within a coastal state’s 200 mile exclusive economic zone, territorial sea, or internal waters. This commentary rejects Kraska et al.'s interpretation and provides evidence to support the claim that coastal state consent under Part XIII of UNCLOS may, under some circumstances, apply to bio-logging. In light of the immense scientific contributions that bio-logging research provide to global marine conservation efforts and the possible burdens that may be imposed on researchers if coastal states begin to assert their rights under UNCLOS, it is important that the international community engage in a robust and candid discussion of the issue and develop a consensus-based approach on how best to move forward.  相似文献

Australia׳s remote location and position on the vast Indo-Australian plate mean that possesses one of the largest continental shelf areas in the world. The criteria in Article 76 of the United Nations Convention on the Law of the Sea permit the claiming on continental shelf to 200 nautical miles from territorial sea baselines, and if certain criteria are met based on the configuration and content of the seabed, to distances beyond. During the negotiations at UNCLOS III, Australia was a strong proponent of this extended shelf regime, as it was likely to have large areas beyond 200 nautical miles. Article 76 provides for a number of requirements to be met for a coastal State to assert sovereign rights over areas of continental shelf beyond 200 nautical miles, including a ten year deadline from becoming a party. This placed a disproportionate burden upon Australia, as it faced the same ten year time frame to lodge data with the Commission on the Limits on the Continental Shelf (CLCS) as other States with much smaller areas in issue. Australia also chose not to rely upon measures agreed between State parties to effectively extend this deadline, and to limit the requirements to be met within it. This paper looks at how Australian authorities approached the difficult task, while maintaining the standards required for data by the CLCS, and how the task was ultimately implemented. It also examines how the extended continental shelf arrangements interacted with the rest of Australia׳s law of the sea practice and maritime boundaries with other States. For example, after the entry into force of the Convention, Australia negotiated two maritime boundaries with neighbouring States that each explicitly dealt with areas beyond 200 nautical miles. It concludes with consideration of what issues remain unresolved in respect of the Australian continental shelf beyond 200 nautical miles. The paper will conclude at how Australia׳s implementation has raised new issues with neighbouring States, including an unresolved dispute in the South Pacific Ocean.  相似文献

A study on the public׳s perceptions and conceptions of global environmental changes (GECs) is relevant to guide future educational strategies and management actions. The present study aimed to: (1) evaluate coastal tourists׳ conceptions and perceptions of GECs; (2) correlate the conceptions presented by tourists about GECs and their self-declared knowledge; (3) evaluate how these tourists perceive their personal contribution to GECs; and (4) verify the frequency at which the media exposed the tourists to information about the influence of GECs on coastal and marine environments. A structured questionnaire was applied to 183 coastal tourists. There was a weak but significant positive correlation (r2=0.152, p<0.001) between self-declared knowledge and the actual conceptions of tourists about GECs and about the sea. Tourists underestimate their role in GECs, pointing out fewer individual actions that contributed to GECs in the questionnaire than expected. Many tourists declared they had never heard of some subjects related to GECs and coastal environments. This study revealed that coastal tourists are still not well informed about their role in GECs and also on their consequences to the society, thus emphasizing the need of more intensive and effective coastal and marine environmental education strategies.  相似文献

海洋是国民经济发展和社会进步的重要空间载体,海洋国土空间开发与保护对于实现可持续的经济增长、改善全球气候环境和提升人民生活福祉具有重大战略意义。山东省海域使用类型基本齐全,但开发利用结构规模不均衡,渔业用海比重较大,不合理的开发利用给海岸带和近海生态环境带来巨大威胁,严重制约了海洋经济的健康发展。文章根据山东省海域使用调查数据,综合分析了山东省海洋空间使用现状的特点以及存在的自然岸线保有压力增大、海洋空间开发利用科学性不足、近岸海域生态系统及服务功能受损较重、海洋污染造成的环境风险不容忽视、现代海洋产业体系不够完善、陆海统筹机制不健全等主要问题,在此基础上,从海洋空间资源、陆海统筹污染防治体系、现代海洋产业体系等角度提出了优化山东省海洋国土空间开发保护的相关对策建议。  相似文献

在全球气候变暖的影响下,中国沿海的海平面上升趋势还将进一步加剧带来海水倒灌、沿海地区水质恶化、生态环境和资源破坏、侵蚀海岸、海洋自然灾害发生的频率增高等一系列危害。为缓解这些危害,首先要掌握海平面的上升速率。潮位观测数据是对海平面进行科学研究的重要依据之一,潮位数据的及时性、准确性、完整性在海平面研究中起主导作用。近年来北方冬季海面结冰现象严重,如不采取相应措施会导致验潮井内结冰,潮位数据中断,从而无法计算平均海平面高度。为防止北方冬季验潮井内结冰,常向验潮井内注入防冻柴油,但注入柴油后,验潮井内液面与外海高度不同,造成潮位观测不准确。根据潮位观测理论和多年实践经验,计算出在不影响潮位读数的情况下,可注入防冻油层的最大高度,并对超过最大高度时潮位读数的修正数值进行了研究。  相似文献

Ecologists have an unprecedented array of bio-logging technologies available to conduct in situ studies of horizontal and vertical movement patterns of marine animals. These tracking data provide key information about foraging, migratory, and other behaviours that can be linked with bio-physical datasets to understand physiological and ecological influences on habitat selection. In most cases, however, the behavioural context is not directly observable and therefore, must be inferred. Animal movement data are complex in structure, entailing a need for stochastic analysis methods. The recent development of state-space modelling approaches for animal movement data provides statistical rigor for inferring hidden behavioural states, relating these states to bio-physical data, and ultimately for predicting the potential impacts of climate change. Despite the widespread utility, and current popularity, of state-space models for analysis of animal tracking data, these tools are not simple and require considerable care in their use. Here we develop a methodological “road map” for ecologists by reviewing currently available state-space implementations. We discuss appropriate use of state-space methods for location and/or behavioural state estimation from different tracking data types. Finally, we outline key areas where the methodology is advancing, and where it needs further development.  相似文献

The global community's ability to assess the environmental effects of marine scientific research (MSR) as required by the 1982 United Nations Convention on the Law of the Sea's (UNCLOS) marine environment provisions (MEP) is limited, as shown by experimental activities that intentionally manipulate the marine environment. Such work enhances knowledge of the ocean, but it may also have significant environmental effects. This growing use of the ocean as a laboratory has global scientific, environmental, legal and policy implications. Examined here is the relationship between the MSR and the MEP provisions of UNCLOS. 详述了我国赤潮航空高光谱遥感应用研究的发展现状,对所发展的赤潮发现检测、生物优势种类识别、生物量分布特征提取技术及所建立的赤潮光谱数据库进行了详细介绍。概述了基于高光谱数据的溢油发生检测及面积信息提取、海冰发生检测及密集度信息反演、海岸带典型要素光谱波段敏感性等的研究进展。从遥感平台、成像光谱仪的角度对我国的海洋航空高光谱遥感发展进行了展望,简要介绍了建设中的国内首套适用于海洋环境与灾害快速监测的海洋航空遥感多传感器集成与应用系统。指出发展我国海洋航空高光谱遥感应用研究的3个关键问题:(1)大量获取海洋及海岸带要素的高光谱数据;(2)开展海洋及海岸带要素现场光谱数据的同步测量研究;(3)大力建设海洋及海岸带要素的地物光谱数据库。  相似文献

The European Union׳s Integrated Maritime Policy (EU IMP) is being developed in the framework of a process that is reshaping maritime geographical scenarios and world geopolitics. This process is characterised by a change in States׳ territoriality resulting from their jurisdictional expansion. Over 60% of coastal States in the world possess territory with a more extensive maritime component than the terrestrial component which helps to reaffirm the fragmentation of maritime space and stresses the national vision of the oceans. Unlike the process of ocean space fragmentation that results from its nationalisation the EU Integrated Maritime Policy has a global and cooperative vision, which is particularly evident in the Atlantic Strategy. In this context, this article aims to: (i) provide a first estimate of the size and extent of the territorial changes resulting from jurisdictional claims available to date and their mapping; (ii) consider the case of the European Union as one of special significance with its express policy of maritime spatial projection. The conclusions point to a redefinition of the large territorial pieces of the global geopolitics puzzle and the emergence of a new Atlanticism associated with the EU׳s maritime policy.  相似文献

The world׳s oceans are currently undergoing an unprecedented period of industrialisation, made possible by advances in technology and driven by our growing need for food, energy and resources. This is placing the oceans are under intense pressure, and the ability of existing marine governance frameworks to sustainably manage the marine environment is increasingly being called into question. Emerging industries are challenging all aspects of these frameworks, raising questions regarding ownership and rights of the sea and its resources, management of environmental impacts, and management of ocean space. This paper uses the emerging marine renewable energy (MRE) industry, particularly in the United Kingdom (UK), as a case study to introduce and explore some of the key challenges. The paper concludes that the challenges are likely to be extensive and argues for development of a comprehensive legal research agenda to advance both MRE technologies and marine governance frameworks.  相似文献

CTD是测量海水温度、电导率和压力的仪器,在海洋科学考察、海洋资源调查开发、海洋环境监测预报和海洋军事研究中应用广泛。SZC15-4型多参数CTD是国产SZC15系列CTD最新型号,用于测量海水的温度、电导率、深度和叶绿素浓度,适用于近岸海洋调查。文中介绍了SZC15-4型多参数CTD剖面仪的性能、工作原理、系统组成和工作流程。并通过海上试验,与SBE19CTD在相同环境条件、相同采样速率下作比测,通过对实验数据做相关运算得出SZC15-4型CTD与SBE19在温度、盐度相关性优于0.999 9,表明两种仪器具有很高的相关特性。  相似文献

Long-term time series of sea state parameters are required in different coastal engineering applications. In order to obtain wave data at shallow water and due to the scarcity of instrumental data, ocean wave reanalysis databases ought to be downscaled to increase the spatial resolution and simulate the wave transformation process. In this paper, a hybrid downscaling methodology to transfer wave climate to coastal areas has been developed combining a numerical wave model (dynamical downscaling) with mathematical tools (statistical downscaling). A maximum dissimilarity selection algorithm (MDA) is applied in order to obtain a representative subset of sea states in deep water areas. The reduced number of selected cases spans the marine climate variability, guaranteeing that all possible sea states are represented and capturing even the extreme events. These sea states are propagated using a state-of-the-art wave propagation model. The time series of the propagated sea state parameters at a particular location are reconstructed using a non-linear interpolation technique based on radial basis functions (RBFs), providing excellent results in a high dimensional space with scattered data as occurs in the cases selected with MDA. The numerical validation of the results confirms the ability of the developed methodology to reconstruct sea state time series in shallow water at a particular location and to estimate different spatial wave climate parameters with a considerable reduction in the computational effort.  相似文献

中等海况下,星载合成孔径雷达(Synthetic Aperture Radar,SAR)已经广泛应用于海洋动力环境要素的监测(风场、波浪、流场)。近年来,SAR高海况遥感,尤其是探测台风海面风场、巨浪、流场已经成为国内外研究热点,并突破了一些关键技术。利用SAR多极化成像模式对海观测和新发展的地球物理模式函数,可以提取高海况下的海面风速、风向、有效波高、流速和流向等海洋表面关键物理参数。这些环境要素可以用于海洋灾害监测预警;为海洋和大气数值模式提供准确的初始场和同化源,改进模式预报精度;为研究全球气候变化提供有力的观测依据。  相似文献

河海界线不明不仅带来执法难、管理难的问题,也使投资环境趋于恶化,对海洋经济的发展有明显的抑制.海河(江)界线划分涉及社会、经济、环境等多个领域,是一项复杂的系统工程.因此建议国家有关部门要重视河海划界工作,成立专门的协调机构和专家组,尽快明确重要河(江)口的河(江)海分界线,并建议全国人大尽快修改<中华人民共和国海域使用管理法>,及时将陆海划界和入海河(江)口河(江)海划界成果吸收进去,使我国沿海各地的海域使用管理更具可操作性,以利于我国沿海河口区域的行政管理,保护河口流域环境,促进经济社会又好又快可持续发展.钱塘江口管理和投资现状具有一定的代表性,以钱塘江口为例,依据钱塘江入海河口的类型及特点,既尊重历史,又着眼于未来,从科学性、合理性、实用性和稳定性等多个角度进行分析与评价,服从和服务于海洋法制建设和海洋综合管理的需要,以促进沿海地区经济社会的发展为最终目标,探讨了钱塘江口江海分界线的位置和划分的依据,认为以澉浦-西三连线作为钱塘江口江海分界线符合自然特性和历史习惯.钱塘江河海分界的划分依据和划分原则也基本适用于其它河口.  相似文献

海岸带空间功能分区是优化海岸带开发与保护的基础性工作,在国土空间规划体系中具有重要作用。当前我国海陆功能分区在分区层级、分区方法等方面并不一致,导致海岸带保护与开发利用失衡。本文在梳理国内外海岸带空间功能分区研究的基础上,从陆海统筹角度出发,构建海岸带空间功能分区体系,并以宁波市为例进行验证,在优先划定生态保护区基础上,对海陆空间进行适宜性评价,根据评价结果确定功能分区。结果表明:(1)宁波市海岸带功能区中生态保护区面积占比约为60%,海陆一体发展区占比约为22.3%,海洋发展区占比约为12.5%,陆地发展区占比约为5.2%;(2)宁波市开发利用功能区空间分布与以临港产业、海洋服务业和海洋渔业为基础的海洋经济发展导向相符。海岸带空间功能分区要以生态保护为底线,以优化空间布局为导向,为优化海岸带开发与保护提供有力支撑。  相似文献

United Kingdom (UK) and European Union policy is rapidly developing to meet international targets for the sustainable use and protection of the marine environment. To inform this process, research needs to keep pace with these changes and research questions must be focused on providing robust scientific evidence. Thirty four priority research questions within six broad themes were identified by delegates who attended the 1st marine and coastal policy Forum, hosted by the Centre for Marine and Coastal Policy Research at Plymouth University in June 2011. The priority questions formed through this research are timely and reflect the pace and change of marine policy in the UK in response to international, European and national policy drivers. Within the data theme, the majority of questions seek to find improved procedures to manage and use data effectively. Questions related to governance focus on how existing policies should be implemented. The marine conservation questions focus entirely upon implementation and monitoring of existing policy. Questions related to ecosystem services focus on research to support the conceptual links between ecosystem services, ecosystem function, and marine management. Questions relating to marine citizenship are fundamental questions about the nature of societal engagement with the sea. Finally, the marine planning questions focus upon understanding the general approaches to be taken to marine planning rather than its detailed implementation. The questions that have emerged from this process vary in scale, approach and focus. They identify the interdisciplinary science that is currently needed to enable the UK to work towards delivering its European and international commitments to achieve the sustainable use and protection of the marine environment.  相似文献
