This paper examines the implications of environmental justice in the regime for Maritime Spatial Planning (MSP) currently developing in the European Union (EU). An ‘ecosystem-based approach’ to marine management is enshrined in the new Integrated Maritime Policy and Marine Strategy Framework Directive and forms the basis of MSP. This concept is intended to encompass all aspects of an ecosystem, including the human element. Yet the modes of including meaningful public participation in the decision-making process for MSP remain undetermined. At the same time, the Aarhus Convention (on access to information, public participation in decision making and access to justice in environmental matters) empowers non-governmental organisations to hold EU Member States to account. Consequently the issue of transparency will gain increased importance, as will linkages between human and environmental rights. Such public interest-based activism on the part of NGOs has the potential to enforce the developing framework for stakeholder engagement within MSP, but it also has implications worth considering regarding the appropriate role of interest-based organisations in the international political arena.  相似文献

This paper surveys the current state and major trends in global fisheries; the environmental and social dimensions of fisheries; and explains how the international community has tried to meet the policy challenges associated with oceans and fisheries. The ocean and the freshwater ecosystems of the world make significant contributions to people's well-being via the many vital social and environmental services they provide (for example, food and nutrition, employment and incomes, carbon cycling and sequestration). The impact that the increase in fishing since the 1950s has had on wild fish stocks, and the significant increase in aquaculture production in the 20th century, have resulted in severe environmental impacts. This has significant effects on marine ecosystems and the health of oceans. The erosion of the resource undermines communities' long-term interests, including food security, employment, and income. Attempts by the global community to address challenges of sustainable production by improving the governance and management of fisheries resources range from national management of fisheries resources, to regional fisheries management organisations (RFMOs) for international fisheries stocks. These attempts have not always successfully met the challenge of balancing current and future use of fisheries.  相似文献

Concepts of security are no longer limited to the military form, but other potential, economic, ecological, social aspects are becoming included.Emphasis needs to be put on integration of all dimensions of security. Many environmental problems present threats to human health and welfare and hence to the well-being of nations. The environmental issues cannot be ignored in context of any comprehensive security concept, but environmental security should not be treated in isolation.Integration of sustainable development and regional security may address many of the current maritime issues. Such integration may best be handled jointly and at regional levels.With this in mind and the realization that there is now a clear awareness and understanding that issues such as poverty, underdevelopment, population growth, environmental quality and sustainable resource use, are interrelated and interdependent and must be dealt with as such, the paper aims to highlight some aspects of regional security and sustainable development issues with reference to the Mediterranean basin. The aim is to initiate a process to pursue integration of sustainable development and comprehensive regional security with focus on the Mediterranean.The approach is based on the concept of the Common Heritage of Mankind as proposed by Arvid Pardo in 1967. It has 4 dimensions: economic; ethical; environmental; peace and security. In dealing with the proposal of Arvid Pardo the United Nations General Assembly decided to split up the concept: the Conference on the Law of the Sea was to deal with the peaceful uses of oceans and sea-beds; the Conference on Disarmament with the security aspects, then considered as military. UNCED 92 maintained the separation in addressing only environment and development, with management also included. However, peace and security were not included. It is time now to include these elements, and also consider the enforcement issue. The paper aims at illustrating this need through some examples from the Mediterranean basin.  相似文献

Aquaculture is an increasingly important economic activity in coastal waters. The fluid environment means spatial management is an important tool for protecting fish health. Scottish aquaculture (largely Atlantic salmon) uses a range of different types of area to group farms for different management or reporting purposes related to fish health. Farm Management Areas are defined by local knowledge and used by industry for co-operation among groups of farms, including in the management of sea lice. Disease Management Areas, defined using a simple but robust model, are used by the Scottish Government for control of notifiable diseases. Particle dispersal models are used to assess areas affected by treatment residue around farms, and to manage maximum allowable area biomass for environmental protection. Sophisticated models of sea lice transport have been developed to help inform management of this key parasite. Large regional areas are used for a variety of purposes, such as a policy presumption against new farms covering the entire east and north coasts of Scotland, and five reporting areas for official production statistics. Scottish aquatic environments are shared by many interest groups and spatial management is proving essential for sustainable development by aquaculture and other users.  相似文献

Islands are often considered to be a priority for conservation, because of their relatively high levels of biodiversity and their vulnerability to a range of natural and anthropogenic threats. However, the capacity of islands to conserve and manage biodiversity may depend upon their governance structures. Many island states are affiliated to other countries through an ‘overseas territory’ status, which may provide them with access to resources and support mechanisms, but which may also influence the capacity for local-scale management of environmental issues. The United Kingdom has 12 island Overseas Territories (UKOTs), most of which support biodiversity of high conservation concern. This study investigates perceptions of current and future threats to marine ecosystems and constraints to environmental protection on the six Caribbean UKOTs, through semi-structured interviews with officials from UK and UKOT government departments and non-governmental organisations. Coastal development, pollution and over-fishing were perceived as threats of most concern for the next decade, but climate change was perceived as by far the greatest future threat to the islands' marine ecosystems. However, a series of common institutional limitations that currently constrain mitigation and conservation efforts were also identified, including insufficient personnel and financial support, a lack of long-term, sustainable projects for persistent environmental problems and inadequate environmental legislation. These findings highlight the need for regional cooperation and capacity-building throughout the Caribbean and a more concerted approach to an UKOT environmental management by the UK and UKOTs' governments.  相似文献

The extent to which flag States are bound by the conservation rules of regional fishery management organisations is an important question in the quest to reduce unregulated fishing. The European Union implemented a trade suspension against Cambodia under Council Regulation 1005/2008, in response to unregulated fishing by Cambodian vessels in high seas areas managed by regional fishery management organisations. Limitations in the arguments underpinning the decision evidence the flaws of unregulated fishing as a legal concept, underlining the need for it to be appropriately interpreted and contextualised in the international legal framework. Clarity on the differences between conventional and customary sources of international legal obligation, and their implications for State consent, should guide the implementation of the Regulation to maximise the normative potential of resulting practices.  相似文献

The role of the Spanish scientific community in the initial assessment of the environmental and socioeconomic damages caused by the Prestige oil spill is analysed. A discussion of the reasons for the failures in the response of the scientific community is presented, highlighting that despite the existence of adequate human capital and infrastructures, failures were related to the weakness of the structures and organisational capacity of the scientific institutions and the public administration. Some developments for an effective response to future catastrophes are proposed: (1) oceanographic and ecological models, including scientific and local knowledge; (2) management systems for scientific information; (3) organisational and incentive systems to allow the creation of temporary, large and well-organised multidisciplinary teams; (4) protocols for rapid, “real-time”, damage assessments; and (5) participation of different social groups (NGOs, fishers’ organisations, aquaculture industry or volunteer groups) in plans for the assessment and management of crises.  相似文献

Mitigating the environmental impact of commercial fishing, by avoiding, minimizing and compensating for adverse effects, is core business for fisheries management authorities globally. The complex interplay of ecological, economic, and social considerations has often resulted in bycatch management being reactive, confrontational and costly. In many cases it has been difficult to demonstrate success and to establish whether bycatch management has been efficient or effective. This article proposes standards for bycatch management following reviews of literature, international agreements and Australian domestic fishery management policies, and consideration by many technical experts and several stakeholder representatives. The standards have been developed using Australian Commonwealth fisheries – and the international fisheries agreements to which Australia is party – as a baseline, but should be applicable to both domestic and regional/international governance systems. The proposed standards involve quantifying fisheries bycatch, agreeing on operational objectives, assessing the effects of fishing on bycatch populations, establishing the cost-effectiveness of mitigation measures, and evaluating performance. The standards encourage domestic management measures that are consistent with the guidance and requirements of international agreements and regional fisheries management organisations. The importance of engaging stakeholders throughout the process is recognised. The standards provide a framework for measuring performance and a checklist of actions for managing bycatch at a fishery level. They have the potential to facilitate the development of more strategic and effective approaches to bycatch management, with defined goals, monitoring systems, and adaptive decision-making. This review of past bycatch management, including the application of the proposed standards to the mitigation of shark bycatch in an Australian longline fishery, demonstrates that the proposed standards are operationally feasible but that they have not always been applied. Specifically, monitoring the performance of bycatch management measures has not always followed their implementation.  相似文献

The development of regional initiatives for the protection of the environment is a cornerstone of international environmental policies. With regard to marine and coastal issues, this regionalisation has mainly been taking place through regional seas programmes and Regional Fisheries Management Organisations. Some regional initiatives and organisations have progressively extended their activities to areas beyond national jurisdiction. This paper aims at analysing these recent developments, highlighting their interests and challenges, and proposing options to strengthen the efficiency of regional actions in these areas. It also highlights the need to consider the global discussions on a possible new global agreement and the development of regional actions as two interconnected processes.  相似文献

A recently completed European collaborative project focused on contributing to the improvement and harmonisation of present design practices for artificial nourishment schemes in Europe. An inventory of and a comparison between the major countries involved revealed significant differences between them regarding engineering methods and evaluation procedures, coastal zone management strategies and legal and financial frameworks. The design and evaluation methodologies were then reanalysed in order to provide harmonised recommendations. This analysis covered the monitoring and assessment of the performance of nourishment projects and the role of numerical models in design and evaluation. This paper summarises the conclusions obtained, uses two case studies as an illustration and gives a number of recommendations for achieving the objectives in the context of soft engineering works. The role of long-term monitoring at a regional scale is emphasised, advocating the use of innovative monitoring technologies together with the need for a better understanding and quantification of autonomous shoreline variability. Finally, suggestions for research are outlined, including such aspects as sediment grading and coupling between shoreline and profile change models.  相似文献

The environmental management of shipping requires systematic consideration of the geography of shipping routes, ship types and cargoes, and environments which can form the basis of a classificatory approach to Environmental Impact Assessment (EIA). Beyond this, effective environmental management depends in the first instance upon sound information management including monitoring of the environment, surveillance of shipping and information technology, followed by information assessment including, in particular, risk and environmental impact. The general management dimension includes co-ordination of technical management and organisational aspects related to shipping. It is suggested that effective environmental management of shipping may depend upon a regionalisation of the marine environment for EIA purposes akin to that found in the loadline rules, together with rationalisation of the increasing number of special areas in existence or proposed for this purpose. EIA will have to become an integral part of the overall management system in the shipping industry.  相似文献

In its capacity to lead and facilitate the development and implementation of integrated management plans under the 1997 Oceans Act, Fisheries and Oceans Canada is working with a range of stakeholders through a collaborative process—the Eastern Scotian Shelf Integrated Management (ESSIM) Initiative—to develop and implement an integrated ocean management plan for the eastern Scotian Shelf off Nova Scotia. Stakeholders include federal and provincial departments, aboriginal communities, municipal and local planning authorities, ocean industry and resource use sectors, coastal communities, environmental interest groups, and university researchers. This large ocean management area possesses important living and non-living marine resources, high biological productivity and diversity, and increasing levels of multiple use and competition for ocean space and resources. The ESSIM vision is to achieve environmental, economic, social/community, and institutional sustainability in the eastern Scotian Shelf.The ESSIM Initiative is building a collaborative planning process that involves all interested and affected parties. Ongoing information sharing and dialogue with stakeholder groups is providing capacity building and important input to current proposals for a collaborative planning structure and the ocean management plan. A joint federal-provincial working group has been established to move the Initiative forward within government and to address policy and regulatory coordination for ocean management. The future ocean management plan will include a balanced set of environmental, social, economic and institutional objectives, indicators and management strategies, as well as spatial and temporal planning approaches to address multiple ocean use.This article provides an overview of the ESSIM Initiative, including an assessment of ocean use, ecosystem understanding, and ocean management and planning requirements. The design of a collaborative management and planning structure and process will be discussed, as well as the key elements of the future integrated ocean management plan.  相似文献

The Amatique Bay is an estuarine ecosystem with great ecological and socioeconomics value due to its diversity of environments, biotic resources and the human activities it supports. However, until the mid-1990’s, the absense of planning and use of ecological criteria in its development have resulted in the environmental deterioration of the ecosystem and its resources. In this constribution the most important ecological aspects of the ecosystem, its economical development, environmental problems, and guidelines for its management are analyzed, putting the ecosystem as focus for planning and management of the Atlantic Coast of Guatemala. The approach enables the analysis of the sectorial levels including tourism, hunting and fishing, agriculture and livestock farming, urbanization, oil-related activities, ports and means of communications, and finally the integration of these activities into the ecosystem and habitats in the region providing management guidelines. In conclusion, it is recommended that the integrated management plan for the Atlantic Coast of Guatemala be grounded in a development strategy based on scientific knowledge, integrating the ecosystem, the economics, and the policy, geared towards the solutions of the priority problem and definition of planning and development policies.  相似文献

An increasing number of scientists and resource managers recognise that successful marine management approaches, including marine spatial planning (MSP), cannot occur without effective monitoring, evaluation and adaptation. These basic components are necessary to ensure that any marine planning or marine management measures are both effective and efficient. While a number of fundamental principles for marine monitoring, evaluation and adaptive management exist, there are varying levels of understanding about how these should be undertaken and what they may achieve. Challenges include the development of realistic and measurable objectives and indicators against which effectiveness can be practically measured. The matter becomes even more complicated as the focus of marine planning and management strategies changes from ‘single species’ to ‘habitats’ and ‘ecosystems’ that may enable a diversity of permitted uses consistent with a variety of overall objectives. Over the last 30 years, the Great Barrier Reef Marine Park (GBRMP) has successfully established a multiple-use spatial management approach that allows both high levels of environmental protection and a wide range of human activities. Drawing on this unique long-term experience in the GBRMP, this article discusses key aspects of effective monitoring and evaluation, and summarises lessons learned from over two decades of adaptive management.  相似文献

Caribbean coastal ecosystems are increasingly being threatened by natural and anthropogenic factors. The scale of these factors is at local, national, regional and global levels. Threats include the effects of fisheries and extraction, eutrophication, siltation, and pollution as well as global climate events such as El Niño and global climate change. Integrated coastal management (ICM) should clearly demonstrate the adverse effects of environmental impacts, thus justifying the need for mitigation and should evaluate the success of management efforts. ICM requires robust indicators that gauge the ‘health’ of the coast in relation to environmental, social and economic activities. Biological indicators (bioindicators) offer a signal of the biological condition in an ecosystem. Using bioindicators as an early warning of pollution or degradation in an ecosystem can help sustain critical resources. Biological indicators in the Caribbean are focused around particular ecosystems, especially coral reefs, seagrass beds and mangrove forests and include a range of biological parameters relating to particular species, groups of species and biological processes. The use of these indicators is critically reviewed and the presence or absence of a relevant framework for their use in Caribbean ICM programs is discussed.  相似文献
