矿政管理中涉及的地权问题

探矿权与采矿权管理是矿产资源行政管理的核心内容。在矿产资源勘查开发过程中不可避免地涉及土地,《矿产资源法》实施细则规定探矿权人享有根据工程需要临时使用土地的权利,采矿权人享有在矿区范围内建设采矿所需要的生产和生活设施和根据生产建设的需要依法取得土地使用权的权利,这就为矿业权人在法律上明确了从事矿业活动可以使用土地。矿权审批和土地权审批是两个程序,只有同时取得了两权之后才能进行合法的矿业活动。因此在矿政管理中要纳入地权管理职责,不应脱节为两个部门的责任。
