| 摘 要： | 矿产资源赋存于土地之中,矿业权与相关土地权利联系紧密。本文以矿业权与土地使用权的基本理论为基础,探讨两者的联系与区别,并研究总结国外矿业权与土地使用权关系的具体表现形式,以期对我国相关制度的完善和国内企业进行境外投资提供一定的参考和借鉴。

| Abstract: | Mineral resources occur in the land and so the mining rights are closely related to the land rights by nature. This paper explores the relationship and distinction between them, and studies and reaches a conclusion on the foreign concrete manifestation of the relationship, so as to provide some reference for the improvement of the Chinese related systems and overseas investments from Chinese enterprises. |
