| 摘 要： | 司法独立和舆论监督的对立统一,是实现"依法治国"的理论前提和制度保证.04年写入"三个代表"精神的宪法,是实现二者对立统一的法理基础和法律依据.促进相关法制建设、广泛应用现代科技、在传媒领域引入市场机制,可在制度和技术层面为其创造现实的可行性.

| Abstract: | The integration of judicial independence and supervision by public opinion, in the sense of theoretical prerequisite and institutional structure, is the basis of rule by law. The constitution amended in 2004 with "Three Represents" offers the jurisprudential rationality and statutory foundation for the integration above, while the feasibility in terms of institution and operation can be available through improvement of laws concerned, application of modern technology and introduction of market system into press field. |
